1. General
1.1. The booking/cancellation terms and conditions are binding for both the tenant and the landlord.
1.2. The reservation can be made orally, by phone, or in writing. For the landlord, it is only binding upon receipt of the due deposit.
1.3. Failure by the tenant to comply with one or more points of this agreement will result in its immediate termination without any claim for damages.
2. Price
2.1. The price list includes both the rental prices for the respective periods and the mandatory cleaning costs and other charges.
2.2. Waste disposal costs amount to a one-time fee of €45 and are included in the rental price.
2.3. Tourist tax is calculated according to the applicable rate and is included in the rental price.
2.4. Bed linens are mandatory and included in the rental price.
2.5. Electricity, water, and heating costs are included in the rental price.
2.6. The cost for the final cleaning is a one-time fee of €350.
2.7. The security deposit amounts to a one-time fee of €1500.
3. Rental Agreement
3.1. The purpose of the vacation home is 'private residence'. The tenant will occupy and use the vacation home as such. (Subletting and/or transfer of the lease are not allowed.)
3.2. The tenant must adhere to the specified payment terms.
3.3. The rental agreement specifies:
• The rental period
• The rent (deposit balance)
• The due costs
• The security deposit
3.4. In the event of a property sale, the contract is void without compensation, and any prepayments will be refunded to the tenant.
4. Payment
4.1. The deposit (50% of the accommodation costs) must be paid within 7 days upon receipt of the rental agreement.
4.2. The remaining balance must be paid no later than 30 days before the start of the stay.
4.3. For reservations made within 30 days before the start of the stay, the entire accommodation costs must be paid immediately and in full.
4.4. The full security deposit is to be paid upon arrival in cash.
4.5. Upon receipt of all the aforementioned payments and documents, the landlord provides the house rules with all practical information.
4.6. In case of announcements by the federal government regarding a pandemic such as COVID-19, the tenant will comply with these measures.
5. Cancellation by the Tenant
5.1. If an agreement is canceled more than 10 weeks before arrival, we will refund the deposit to your account; for cancellations within 10 weeks before arrival, this refund is forfeited. For cancellations less than 30 days before the stay, cancellation costs equal to the total accommodation costs are due.
6. Care for House and Environment
6.1. The rented vacation home must be occupied by the tenant and accompanying individuals with due care, considering the tranquility of the surroundings. If the tenant or accompanying individuals do not act as a "good housekeeper" or cause serious inconvenience or disturbance to the environment, their further access to the vacation home may be immediately denied, and the rental agreement automatically terminated without any entitlement to refund or compensation.
6.2. In case the tenant or accompanying individuals unexpectedly cause damage to the rented house and/or belongings, this must be reported immediately to the landlord or authorized person. The related repair and replacement costs must be promptly reimbursed. The tenant is liable for damage caused by them or by those accompanying them, even if this damage is noticed after their departure.
6.3. The security deposit, minus any damages or costs, will be refunded to the tenant within 2 weeks after the stay.
6.4. The tenant must ensure during their stay that necessary basic maintenance is carried out. Any extreme cleaning costs will be charged in addition to the security deposit.
6.5. Bath towels and kitchen towels must be provided by the tenant in sufficient quantities.
6.6. Pets are allowed access to the property after consultation with the landlord.
6.7. The tenant is advised to insure their legal liability (e.g., building insurance).
7. Landlord's Commitment
7.1. The landlord is obliged, if all conditions are met, to honor his commitment to the tenant.
7.2. If, due to force majeure or sale of the property, the landlord cannot fulfill the agreement, they are obligated to immediately inform the tenant by email and refund all prepayments without the tenant being entitled to any compensation.
7.3. The landlord accepts no liability for loss, abandonment, theft, damage, injury, accident, etc., caused to persons, animals, and/or property during or as a result of a stay in the vacation home.
7.4. The landlord cannot be held liable for inconveniences caused beyond their control; for example, poor quality of utility services, etc.
8. Reception
8.1. The key will be made available to the tenant on time.
8.2. Any deficiencies, incomplete inventory, damage to materials, etc., noticed upon arrival at the vacation home must be reported immediately to the landlord or their representative.
8.3. Upon leaving the vacation home, the tenant must ensure that the prescribed tasks (as per house rules) are strictly performed. Violations will result in additional costs being charged.
